Bin Shift Mate Terms & Conditions of Service

This is an agreement between you and Bin Shift Mate (ShopMakesSense Ltd. and its affiliates, „Bin Shift Mate” or „we”). Before using Bin Shift Mate, please read these Bin Shift Mate Terms and Conditions of Service, the Bin Shift Mate Privacy Notice, the Bin Shift Mate Recurring Payment Terms and Conditions, and other applicable rules, policies, and terms posted on the Bin Shift Mate website or available through your Bin Shift Mate app (collectively, this “Agreement”). By using Bin Shift Mate, you agree to be bound by the terms of this Agreement. If you do not accept the terms of this Agreement, then you may not use Bin Shift Mate.

You agree to contract with Bin Shift Mate to perform the service of taking out and returning your waste and recycling bins at the specified address. This is a monthly Service Contract, and you agree to pay Bin Shift Mate monthly in advance for the services provided that month.

Definitions

For the purposes of these Bin Shift Mate Terms and Conditions of Service:

  • “Bin Shift Mate” refers to Bin Shift Mate’s bin management service.

  • “Software” refers to all software and related documentation that we make available to you for use with Bin Shift Mate.

  • “Runners” refers to individuals employed or contracted by Bin Shift Mate to provide the bin management service.

Home Access

By submitting your service subscription request online, you authorise Bin Shift Mate and its runners to access your property (or other designated location) for the purpose of taking out and returning your waste and recycling bins. By subscribing to our service, you confirm you have the right to authorise Bin Shift Mate and its runners to access the property. It is your responsibility to ensure that Bin Shift Mate or its runners have full access to your waste and recycling bins on the scheduled service dates. Should Bin Shift Mate or its runners be unable to provide the service due to lack of access, you shall not be entitled to a credit or refund.

Service

Bin Shift Mate or its runners will take out your waste and/or recycling bins on your designated collection day. After your waste and/or recycling has been collected, Bin Shift Mate will return your bins to their original storage location. You agree that for a flat monthly fee, Bin Shift Mate will take out and return 1 waste bin and 1 recycling bin per week for 1 calendar month, totalling 4 visits per month.

Unemptied Bins

If the waste has not been collected on the specified day, we will proceed according to the instructions provided on the order form. If the customer does not wish for us to return the full bin to its place, it is the customer’s responsibility to do so after the next collection.

Schedule Changes

In the event that the collection schedule changes and the customer does not inform us of these changes in advance, the customer will be responsible for taking the bin out and bringing it back in.

Bin Access

You must ensure Bin Shift Mate or its runners have access to your waste and recycling bins on the scheduled service day. This includes providing gate entry codes, lock combinations, security guard verification, and ensuring pets are relocated from storage areas. If Bin Shift Mate or its helpers are unable to access your bins, services will not be performed that week, and you shall not be entitled to a credit or refund. Bin Shift Mate reserves the right to decline service for any reason.

Pricing

You agree to pay Bin Shift Mate the current monthly recurring service fee plus applicable VAT. The monthly base service fee is £35 includes VAT. Bin Shift Mate reserves the right to increase or decrease the service fee at any time at its sole discretion.

Change in Price

In the event of a price change, Bin Shift Mate will provide you with two months’ written notice. If you disagree with the new price, you may cancel the service. If you do not cancel, you will be charged the new service fee.

Billing

Service is billed at the start of each month and continues on a recurring monthly basis unless you request cancellation.

Payment Terms

By accepting these terms, you are enrolling in Bin Shift Mate’s Payment Plan and agreeing to the Bin Shift Mate Recurring Payment Terms and Conditions. You authorise Bin Shift Mate to charge your Payment Method for the agreed-upon services.

Cancellation

Either party may cancel the service with one month’s advance notice, except where special volume pricing has been granted. Cancellation must be done in writing at binshiftmate@gmail.com. No partial credit or refund will be given.

Pets

You are responsible for ensuring pets are contained and do not interfere with the service.

Vehicles

Bin Shift Mate is not responsible for any damage to vehicles that may occur due to bins being hit by vehicles.

Safety Issues

It is your responsibility to maintain compliance with local council regulations regarding fencing, gates, and other safety concerns.

Customer Satisfaction

If a job is unsatisfactory, notify Bin Shift Mate within seven days for resolution.

Changes to Bin Shift Mate

We may change, suspend, limit, or discontinue Bin Shift Mate or any part of it at any time without notice. We may amend the Agreement by posting revised terms on the Bin Shift Mate website. Your continued use of Bin Shift Mate after the effective date of the revised Agreement constitutes your acceptance of the new terms.

Short-Term Rental Liability Clause for Residents’ Association Fines

If the property signed up for service is designated for short-term rental use, Bin Shift Mate is not liable for any fines or penalties issued by Residents’ Association . You assume responsibility for compliance with Residents’ Association rules and agree to indemnify Bin Shift Mate.

Disputes/Binding Arbitration

Any dispute arising from this Agreement is subject to binding arbitration in accordance with UK law.

Disclaimer

Bin Shift Mate is not responsible for damage to bins, property, or vehicles due to natural events, vandalism, or misuse.

Recurring Payments Terms & Conditions

By accepting these terms and conditions through your election to enrol in the Payment Plan selected by you, you hereby authorise Bin Shift Mate to bill and charge the Payment Method and its associated Payment Account that you have specified according to the Payment Plan you have selected.

Your Bin Shift Mate service will automatically renew at the end of each period selected in your Payment Plan (either monthly, every 6 months, or every 12 months). Bin Shift Mate will automatically charge the full amount of Payment to your Payment Method each time your service renews, unless you cancel according to the terms and conditions stated below.

Payments, Payment Account and Payment Method

You agree that the Payment Method specified by you for automatic Payments to Bin Shift Mate is, and will continue to be, an account that you own, and that you will maintain sufficient availability under your credit card limit, or sufficient funds in the account linked to your debit card or other mode of payment, as applicable, to make your Payments. The automatic charge to your Payment Method will occur on the Billing Date of the month(s) of payment according to your Payment Plan. In addition, Bin Shift Mate may subscribe to an account updater service, which may be supported by your Payment Method issuer, such as your credit card provider or bank. If your Payment Account number or Payment Account expiration date changes, you understand and agree that your Payment Method issuer may notify Bin Shift Mate of such changes in order for Bin Shift Mate to update your Payment Account information on file and charge automatic Payments to your new Payment Account information.

Automatic Renewal

Your service will continue for the length of the initial term you selected for your Payment Plan and at the end of your Payment Plan term, it will automatically renew for additional prepaid periods of the same length unless you choose to cancel prior to that renewal, or your Bin Shift Mate service is cancelled, terminated, or discontinued by you or by Bin Shift Mate. Your Payment Method will automatically be charged at the rates in effect at the time of renewal.

Notification of Payments

With the exception of a confirmation email sent to you from Bin Shift Mate confirming your selected Payment Plan, you may not receive any receipt of payment emails to your Email Account notifying you that a Payment has been made under the Payment Plan. Such confirmation email may be your only notification from Bin Shift Mate regarding your Payments under the Payment Plan. You understand and agree that Bin Shift Mate may not provide you with advance notification before a Payment is charged to your Payment Method.

Current Information

It is your responsibility to make sure that your Payment Method information and Email Account information are current at all times during the term of the Payment Plan.

Payment Method Declined

If any Payment charged to your Payment Method is declined, you authorise Bin Shift Mate to make additional attempts each day for up to five (5) consecutive days thereafter to successfully charge your Payment Method, if possible under such Payment Method. If Bin Shift Mate is unable to successfully charge your Payment Method after such time and you have a recurring Payment Plan, you authorise Bin Shift Mate to reattempt Payment Method authorisation as stated herein for two (2) additional consecutive months.

Cancellation

Cancellation of your Bin Shift Mate service shall be effective at the time of cancellation. Cancellation of your Bin Shift Mate service must be made on a Business Day and more than 1 month before the Billing Date, except in the case of special volume pricing, or your Payment Method will be charged for the then due Payment. Special volume pricing requires a minimum of 3 months advance notice of cancellation.

If you cancel your enrolment for recurring Payments on a monthly Payment Plan, and you wish to remain a part of the Bin Shift Mate service, you will be responsible for taking the appropriate action to pay the appropriate service fees for the next month on or before the end of each month. Cancellation fees may apply if you cancel your Bin Shift Mate service prior to the end of any minimum commitment period. Bin Shift Mate reserves the right to waive any cancellation fee, in whole or in part, at its discretion. Bin Shift Mate's failure to enforce a cancellation fee or any other provisions of these Terms and Conditions shall not be construed as a waiver of the right to assert any such terms on any future occasion.

Messaging Terms & Conditions

General

When you opt-in to the service, we will send you a message to confirm your signup.

By opting into messages, you agree to receive recurring automated marketing and informational text messages from Bin Shift Mate. Automated messages may be sent using an automatic telephone dialling system to the mobile telephone number you provided when signing up or any other number that you designate.

Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with Bin Shift Mate. Bin Shift Mate reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Bin Shift Mate also reserves the right to change the short code or phone number where messages are sent.

Message and data rates may apply. If you have any questions about your text plan or data plan, it is best to contact your mobile service provider. Your mobile service provider is not liable for delayed or undelivered messages.

Your consent to receive marketing messages is not a condition of purchase.

Mobile Networks

Mobile networks are not liable for delayed or undelivered messages.

Cancellation

You can cancel at any time by texting “STOP”. After you send the SMS message “STOP”, we will send you a message to confirm that you have been unsubscribed, and no more messages will be sent. If you would like to receive messages from Bin Shift Mate again, just sign up as you did the first time, and Bin Shift Mate will start sending messages to you again.

Transfer of Number

You agree that before changing your mobile number or transferring your mobile number to another individual, you will either reply “STOP” from the original number or notify us of your old number at binshiftmate@gmail.com. The duty to inform us based on the above events is a condition of using this service to receive messages.

If you have any questions about your data or our privacy practices, please refer to our Terms and Conditions above.

Messaging Terms Changes

We reserve the right to change or terminate our messaging programme at any time. We also reserve the right to update these Messaging Terms at any time. Such changes will be effective immediately upon posting. Your continued enrolment following such changes shall constitute your acceptance of such changes.
